VISUAL DEFECTS
Visual defects are only considered defects when the defect would show when the product is installed in a typical fashion, as finished/presented on the website and as designed for. Visual Defects are defined as clearly visible defects from a standard viewing distance in a usual application (across a pool or in a wall behind a fountain basin) and do not meet our internal quality standards. Majestic Water Spouts holds the sole discretion to determine what is considered a defect in a product based on internal quality standards and guidelines.
Visual defects or damaged products must be reported to Majestic Water Spouts within 3 days of delivery to be eligible for replacement or repair. No replacements or repairs for visual defects will be provided If the product is used, installed or not in new salable condition.

TOLERANCES
Due to variations in stock materials that are cut, bent, finished, etc, delivered product(s) may vary from specified or requested dimensions by .25” or 1%, whichever is larger. We do our best to hit dimensions dead on, but please account for this variance when ordering. Note that crowning and bowing material(s) may exist and do not affect performance but will be within noted allowed tolerances specified.
Products are designed and engineered to the best of our ability by experts who have designed and tested numerous water feature products. Due to the many factors outside of our control including application, complete system, and installation: we cannot guarantee the performance of products other than completion of manufacturing to the specifications as provided. Our engineers use top of the line tools, their education and previous experiences to design the best looking and performing products for your application. We do not offer refunds and/or returns due to engineering issues or flaws.
Product performance may degrade with use due to the conditions and the environment exposed to. Product performance degradation is not covered by this guarantee.
COLOR AND MATERIAL VARIATIONS
Due to the characteristics of metals, plastics and other materials we use, there may be variations in colors and finishes. Color samples may appear slightly different than your actual production piece. Additionally, computer monitors display colors in photo images slightly differently, depending on a wide variety of different settings and actual monitors. Therefore, a specific product image or color you see on your computer monitor, may be a different shade to the actual piece.
No refunds or replacements will be issued based on finishes that are unsatisfactory to the customer but meet the quality standards of Majestic Water Spouts.
CONDITIONS
We guarantee our products will be free from manufacturing defects for the reasonable lifetime of the project for which it was originally purchased. This Limited Guarantee is provided to the original purchaser only and shall not apply if the product is damaged due to shipping/transit, handling after shipment arrival, abuse, alteration, misuse, negligence, improper installation, lack of maintenance, normal wear and tear, insufficient or excessive electrical/water/gas supply, abnormal operating conditions, exposure to the elements, fire, or acts of God. Majestic Water Spouts holds the sole discretion to what is considered craftsmanship issues.
Finishes subject to water, chemicals and sunlight are not covered under this Limited Guarantee. This includes, but is not limited to copper's natural patina evolution, Corten and stainless steel developing surface rust and powder coated finishes fading. Powder Coated finishes are only guaranteed against an application defect and are limited to (1) one-year.
The obligation of Majestic Water Spouts is limited to the repair or replacement of the defective product and excludes return shipping costs, damages to property or individuals, and labor costs to remove and replace the product. NO refunds will be granted.
In the event that any part or provision of this Limited Guarantee shall conflict with any present or future law, statute, ordinance, regulation or ruling, the latter shall prevail; provided the part or provision of this Limited Guarantee affected shall be curtailed and limited only to the extent necessary to bring it within the requirements of law, and all other parts and provisions of this Limited Guarantee shall remain in full force and effect.
THIS GUARANTEE IS EXCLUSIVE AND IN LIEU OF ALL OTHER OBLIGATIONS, LIABILITIES AND WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL MAJESTIC WATER SPOUTS, OR IT'S DISTRIBUTORS AND RETAILERS, BE LIABLE OR RESPONSIBLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR OTHER DIRECT OR INDIRECT DAMAGE, LOSS, COST, EXPENSE, OR FEE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THIS MAY NOT APPLY TO YOU. IN NO EVENT SHALL MAJESTIC WATER SPOUTS LIABILITY EXCEED THE COST OF THE PRODUCT.
